ShareGarage Terms and Conditions of Service
Last Updated: October 2026
THE FOLLOWING TERMS AND CONDITIONS (“Terms”) are applicable to all rentals made by ShareGarage, LLC, a Texas limited liability company. These Terms govern your access to and use of the ShareGarage platform operated by ShareGarage LLC (“ShareGarage,” “we,” “us,” or “our”). These Terms shall supersede any prior understandings, transactions or communications, whether written or oral, with respect to the matters referred to herein
By creating an account, listing an item, requesting or accepting a rental, completing a rental transaction, or otherwise using ShareGarage, you agree to these Terms.
1. What ShareGarage Is
ShareGarage is a peer-to-peer online marketplace that connects individuals who own items with individuals who wish to rent those items.
ShareGarage provides technology that facilitates listings, rental requests, bookings, payments, communications, reviews, and related marketplace functions.
ShareGarage does not own, manufacture, inspect, maintain, repair, deliver, operate, control, or guarantee items listed by users.
Owners and renters contract directly with one another regarding individual rental transactions. Except as expressly stated in these Terms, ShareGarage is not a party to the underlying rental arrangement between an owner and renter.
2. Eligibility and Accounts
You must be at least 18 years old and legally capable of entering into a binding contract to use ShareGarage.
You agree to provide accurate and current account information and to complete identity, payment, or other verification when required.
You are responsible for maintaining the confidentiality of your account credentials and for activity occurring through your account.
Accounts may not be transferred or used to impersonate another person.
3. Owner Responsibilities
By listing an item, the Owner represents and agrees that:
the owner legally owns the item or otherwise has the legal right to rent it;
the listing accurately describes the item and its condition;
photographs and other listing information are accurate;
the item is in reasonably safe, functional, and properly maintained condition when provided to the renter;
known defects, hazards, limitations, and required safety precautions will be disclosed;
the item complies with applicable laws and ShareGarage policies;
the owner will honor confirmed bookings;
the owner is responsible for determining whether any licenses, permits, insurance, instructions, protective equipment, or other requirements apply to the item or its rental; and
the owner remains responsible for the item itself and for representations the owner makes concerning it.
ShareGarage's acceptance or publication of a listing does not constitute an inspection, certification, endorsement, or representation that an item is safe or suitable for use.
SHAREGARAGE MAKES NO WARRANTY, CONDITION OR REPRESENTATION WHATSOEVER AS TO THE QUALITY, CONDITION, OR SUITABILITY OF THE EQUIPMENT FOR THE RENTER’S PURPOSES. SHAREGARAGE DISCLAIMS ANY IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR USE OR PURPOSE. SHAREGARGE IS UNDER NO OBLIGATION TO INSPECT , SERVICE OR OTHERWISE RENDER OR MAINTAIN THE EQUIPMENT FOR THE BENEFIT OF THE RENTER OR OWNER.
4. Renter Responsibilities
Renters agree to:
inspect an item before using it;
follow manufacturer instructions and owner-provided instructions;
use the item only for its intended and lawful purpose;
possess the knowledge, ability, licenses, permits, and qualifications required to operate the item, where applicable;
not permit unauthorized individuals to use the item;
take reasonable precautions to prevent injury, loss, theft, or damage;
stop using an item if it appears unsafe, damaged, or malfunctioning; and
return the item on time and substantially in the condition in which it was received, ordinary wear excepted.
A renter is responsible for determining whether they are capable of safely using a rented item.
5. Bookings and Payments
Rental transactions must be booked and paid through ShareGarage.
Users may not circumvent ShareGarage's payment system to avoid platform fees or other requirements.
Payments are processed using third-party payment providers, including Stripe.
ShareGarage is not a bank or escrow service and does not hold funds on users' behalf as an escrow agent.
6. ShareGarage Platform Fee
ShareGarage charges owners a 10% platform fee on completed rental transactions.
Unless otherwise disclosed for a particular transaction, the platform fee is calculated from the rental price and deducted from the owner's rental proceeds.
For example, on a $100 rental:
Gross owner rental earnings: $100
ShareGarage platform fee: $10
Owner net rental earnings: $90
Renters are not charged a separate ShareGarage platform fee under the current fee structure.
ShareGarage may modify its fee structure prospectively by providing appropriate notice.
7. Taxes
Applicable sales or other transaction taxes may be collected in connection with rentals made through ShareGarage.
Taxes collected from renters are not owner earnings and are not ShareGarage platform-fee revenue.
ShareGarage may calculate, collect, report, or remit taxes when required by applicable law.
Users remain responsible for taxes or reporting obligations imposed directly upon them.
8. Security Deposits and Damage Claims
An Owner may require a security deposit for an item.
A security deposit is separate from rental earnings and does not constitute ShareGarage revenue.
ShareGarage may facilitate authorization, holding, release, or capture of security-deposit funds through its payment provider.
Renters may be responsible for qualifying loss or damage occurring during a rental.
Owners must submit damage claims and supporting information within the time period established by ShareGarage.
ShareGarage may facilitate the damage-claim process but does not guarantee reimbursement to an owner or determine legal liability between users.
9. Cancellations and Refunds
Refund eligibility is determined by the applicable ShareGarage cancellation and refund rules and the circumstances of the transaction. The Owner cancellation rules below apply when an Owner cancels a confirmed, paid booking before the rental is fulfilled.
An Owner-issued partial refund does not automatically reduce or refund ShareGarage's platform fee. Any refund or fee adjustment in other circumstances remains subject to the applicable cancellation and refund rules.
Non-Refundable Fee. The ShareGarage platform fee is generally non-refundable except as expressly provided in the applicable cancellation and refund rules. If an Owner cancels a confirmed, paid booking before the rental is fulfilled, the Renter will receive a full refund of the rental payment, including associated refundable sales tax, without any deduction for the ShareGarage platform fee, and ShareGarage will waive its platform fee for that booking.
No Owner Cancellation Fee. ShareGarage does not charge Owners a cancellation fee. An Owner who cancels a confirmed, paid booking receives no rental earnings from that booking, and ShareGarage waives its platform fee for that booking.
Where a transaction must be fully voided or reversed, ShareGarage may waive or reverse its platform fee when appropriate.
Taxes associated with refunded taxable amounts will be adjusted as required.
Renter Cancellations
If a Renter cancels a confirmed, paid booking 24 hours or more before the scheduled pickup time, the Renter will receive a refund of ninety percent (90%) of the rental price.
If a Renter cancels less than 24 hours before the scheduled pickup time, the Renter will receive a refund of fifty percent (50%) of the rental price.
No additional cancellation fee is charged on top of these refund amounts.
ShareGarage retains its existing ten percent (10%) platform fee on Renter-initiated cancellations, as applicable under the disclosed payment terms.
Applicable sales tax will be refunded or adjusted as required by Texas law, taking into account the tax treatment of any amounts retained following cancellation.
The 24-hour period is measured from the scheduled pickup time in the local time zone of the rental.
For example, on a $100 rental, a Renter who cancels 24 hours or more before pickup receives a $90 rental-price refund, and a Renter who cancels less than 24 hours before pickup receives a $50 rental-price refund, in each case plus any applicable refundable sales tax.
Owner Cancellations
Owners are expected to honor confirmed rental bookings. If an Owner cannot provide an item as agreed, the Owner should promptly cancel the booking through ShareGarage.
If an Owner cancels a confirmed, paid booking before the rental is fulfilled, the Renter will receive a full refund of the rental payment, including the corresponding refundable sales tax. The Owner receives no rental earnings from that canceled booking.
The canceling Owner is not charged a cancellation fee, and ShareGarage does not retain its platform fee on the canceled booking.
For example, if the rental price is $100 and applicable sales tax is $8.25, the Renter originally pays $108.25. If the Owner cancels before fulfillment, the Renter receives a full $108.25 refund, the Owner receives $0 in rental earnings, and ShareGarage retains no platform fee.
Repeated or improper Owner cancellations may result in restrictions on the Owner’s listings or account.
10. Pickup, Return and Condition Documentation
Owners and Renters should inspect the item at pickup and return.
ShareGarage may allow or require photographs, condition notes, timestamps, messages, or other documentation relating to an item's condition.
Such documentation may be considered when facilitating a dispute but does not make ShareGarage an inspector or arbitrator of the item's safety.
11. Prohibited Items and Conduct
Users may not list or transact in items prohibited by ShareGarage's Prohibited Items Policy.
Prohibited categories include, among other things, firearms and ammunition, explosives and fireworks, illegal drugs, alcohol, hazardous chemicals, fuels and certain flammable materials, biohazards, stolen or counterfeit property, sexually explicit or illegal items, and other items prohibited by ShareGarage or applicable law.
ShareGarage may remove a listing or restrict an account when it reasonably believes a listing or activity violates these Terms or platform policies.
12. ASSUMPTION OF RISK
Renting, possessing, transporting, operating, and using physical items may involve risks of property damage, bodily injury, serious injury, or death.
To the fullest extent permitted by applicable law, renters knowingly and voluntarily assume the risks associated with possession and use of items rented from other ShareGarage users, including risks arising from the nature, condition, operation, transportation, or use of those items.
Owners and renters acknowledge that ShareGarage does not independently inspect or certify listed items, and ShareGarage cannot be responsible for any damages arising out of the renting, possessing, transporting, operating and use of the physical items being rented herein The Renter shall bear the risk with respect to any damages, destruction, loss, theft, seizure or otherwise takings of the equipment being rented herein.

(h) a dispute between you and another user arising from or relating to a rental transaction; or
(i) taxes, permits, licenses, regulatory requirements, or other obligations for which you are responsible.
ShareGarage reserves the right, at its own expense, to assume the exclusive defense and control of a matter otherwise subject to indemnification. You agree to reasonably cooperate in that defense.
You may not settle a claim in a manner that imposes liability, obligations, admissions, or restrictions upon ShareGarage without ShareGarage's prior written consent.
.
15. No Insurance or Guarantee
ShareGarage does not provide users with insurance, a protection plan, reimbursement guarantee, or guarantee regarding the safety, condition, legality, availability, or performance of an item.
Users are responsible for obtaining any insurance they determine is appropriate for their activities.
Nothing in these Terms describes or limits any separate insurance coverage maintained by ShareGarage for ShareGarage's own business.
16. Disputes Between Users
Owners and renters are primarily responsible for resolving disputes arising from their rental transaction.
ShareGarage may choose to provide tools or assistance for communications, damage documentation, refunds, or other dispute-related matters.
Providing such assistance does not make ShareGarage responsible for the underlying dispute or obligate ShareGarage to resolve it.
17. Disclaimer of Warranties
To the fullest extent permitted by law, ShareGarage and its services are provided “AS IS” and “AS AVAILABLE.”
ShareGarage does not warrant or guarantee the condition, safety, legality, quality, accuracy, reliability, availability, suitability, or performance of items, listings, users, or rental transactions.

To the fullest extent permitted by applicable law, ShareGarage will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the platform or transactions between users.
19. User Content
Users retain ownership of photographs, descriptions, reviews, messages, and other content they submit.
By submitting content, users grant ShareGarage a non-exclusive, worldwide, royalty-free license to host, reproduce, display, distribute, and use that content as reasonably necessary to operate, improve, market, and promote ShareGarage.

Prior to any legal action, any claims by Renter or Owner must be presented to ShareGarage in writing and such parties shall use best efforts, acting in good faith, to resolve in any conflict or dispute.
24. Electronic Agreement and Transaction-Specific Acknowledgment
Users consent to entering into agreements with ShareGarage electronically.

ShareGarage may maintain records of such acceptance, including the user, booking, date and time of acceptance, and version of the applicable terms or acknowledgment.
Our intended checkout design is:
☐ I acknowledge that I am renting an item from another ShareGarage user, not from ShareGarage, and I agree to the applicable Assumption of Risk, Release, and Indemnification provisions.
25. Changes to These Terms
ShareGarage may update these Terms from time to time.
When required, material changes will be communicated through the platform, email, or another reasonable method.
Changes apply prospectively according to the effective date stated in the updated Terms.
